Statement on Resolution 22-102

“Resolution 22-102 was not scheduled because, after review, there were serious concerns that the measure was legally and operationally flawed. As drafted, the proposal went beyond a straightforward term limits question. It would have changed candidate eligibility rules, retroactively counted prior service, and created a scenario in which a candidate could win an election but be barred from taking office, thereby requiring the Council to call another special election. That could have created voter confusion, legal uncertainty, and additional public costs, including the potential cost of holding multiple, off-year elections. Charter amendments placed before voters should be clear, legally sound, and not create unintended consequences. In this case, the resolution did not meet that standard.” Council Chair Tommy Waters
